1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the website https://hapsports.in/ (the "Website") and the Hatsun Badminton Centre mobile application (the "App") (collectively, the "Platform"), operated by HAP Sports Trust, a non-profit trust running the Hatsun Badminton Centre ("HBC", "we", "us", "our") at No. 1 Raja KSP Ganesan Salai, Keezha Thiruthangal, Thiruthangal – 626 130, Tamil Nadu, India.By accessing, downloading, registering on, or otherwise using the Platform, you ("User", "you", "your") confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Platform.2. Definitions
"Academy" refers to the physical premises and operations of Hatsun Badminton Centre."Trainee" / "Player" refers to any individual enrolled in a coaching programme."Parent / Guardian" refers to a parent or lawful guardian of a Trainee who is below 18 years of age."Content" includes all text, images, videos, logos, graphics, software, and other material made available through the Platform.3. Eligibility
The Platform is intended for use by individuals aged eighteen (18) years or above. Individuals between thirteen (13) and seventeen (17) years may use the Platform only under the supervision and with the verifiable consent of a parent or lawful guardian.By registering on behalf of a minor, the Parent / Guardian represents and warrants that they have full legal authority to provide consent and accept these Terms on behalf of the minor.You confirm that you are not barred from receiving services under the laws of India or any other applicable jurisdiction.4. User Accounts and Registration
To access certain features (such as enrolment, attendance tracking, performance updates, and notifications), you must register on the Platform and provide accurate, current, and complete information.You are responsible for maintaining the confidentiality of your account credentials, including any passwords and Google Sign-In tokens, and for all activities under your account.You agree to notify us immediately of any unauthorised access to or use of your account.We reserve the right to refuse registration, suspend, or terminate accounts containing false, misleading, or incomplete information.5. Enrolment and Coaching Services
Acceptance into a coaching programme is at the sole discretion of HBC and is subject to evaluation, available capacity, and category eligibility (Under 10, Under 11, Under 13, Under 15, Under 17, Under 19, Seniors, etc.).HBC reserves the right to modify training schedules, coaches, programmes, and venues without prior notice when necessary.Trainees and Parents / Guardians are required to comply with all academy rules, dress codes, attendance requirements, and the Code of Conduct issued by HBC from time to time.Continued enrolment is subject to satisfactory progress, discipline, and adherence to the Code of Conduct.6. Fees and Payments
Where applicable, fees for programmes, equipment, or events shall be as published by HBC and are payable in accordance with the schedule communicated at the time of enrolment.All fees are non-refundable unless expressly stated otherwise or required by law.Failure to pay applicable fees on time may result in suspension or termination of services.7. Mobile Application Licence
Subject to your compliance with these Terms, HBC grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on a compatible device for your personal, non-commercial use. You shall not:
Copy, modify, distribute, sell, or lease any part of the App.Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by law.Use the App in a way that may damage, disable, overburden, or impair our systems.Use any automated means (bots, scrapers, crawlers) to access the App.Circumvent any security or authentication measures.8. Acceptable Use
You agree not to use the Platform to:
Upload, post, or transmit any content that is unlawful, defamatory, obscene, abusive, threatening, harassing, or otherwise objectionable.Impersonate any person or misrepresent your affiliation with any individual or entity.Submit false information about a Trainee, parent, achievement, or medical condition.Infringe the intellectual property, privacy, or other rights of HBC or any third party.Distribute viruses, malware, or other harmful code.Engage in conduct that disrupts the experience of other users or the operation of the Platform.9. Photographs, Media, and Publicity
By enrolling, you grant HBC a non-exclusive, royalty-free licence to use photographs, video recordings, achievements, and tournament results of the Trainee for academy records, the Hall of Fame, the Website, the App, social media handles, and promotional materials.If you do not wish for a Trainee's image to be used for promotional purposes, you must communicate this in writing to hatsunbadminton@hap.in, and we will make reasonable efforts to honour your request prospectively.For Trainees who are minors, this licence is granted by the Parent / Guardian.10. Intellectual Property
All Content on the Platform, including the HBC and HAP logos, trademarks, coaching curricula, training materials, photographs, videos, and software, is owned by or licensed to HAP Sports Trust and is protected by Indian and international intellectual property laws.You may not reproduce, republish, distribute, or create derivative works from any Content without our prior written consent, except for personal, non-commercial viewing.Any feedback, suggestions, or ideas you submit may be used by us without obligation or compensation.11. Health, Safety, and Assumption of Risk
Participation in badminton training and tournaments involves inherent physical risks, including but not limited to muscle strains, sprains, fractures, and other injuries.By enrolling, you acknowledge and voluntarily assume these risks on your own behalf, or on behalf of the minor under your guardianship.You are required to disclose all relevant medical, physical, and psychological conditions at the time of registration and to keep this information current.You confirm that the Trainee is medically fit to participate in the programme and agree to obtain medical clearance where appropriate.HBC shall not be liable for any injury, loss, or damage arising from undisclosed medical conditions or non-compliance with safety instructions.12. Code of Conduct
All Trainees, Parents, Guardians, and visitors are expected to:
Treat coaches, staff, fellow players, and visitors with respect and dignity.Refrain from any form of harassment, bullying, discrimination, or violence.Comply with safety guidelines, infrastructure usage rules, and instructions of coaches.Avoid the use of tobacco, alcohol, or prohibited substances on academy premises.Not engage in any conduct that brings disrepute to HBC, HAP Sports Trust, or its affiliates.Violation of the Code of Conduct may result in warnings, suspension, or termination of enrolment and access to the Platform, without refund.
13. Third-Party Services and Links
The Platform may integrate with or link to third-party services, including Google Sign-In, social media platforms, payment gateways, and external websites. HBC is not responsible for the content, policies, or practices of such third parties. Your use of those services is governed by their respective terms and policies.14. Disclaimers
The Platform and all services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.HBC does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee specific outcomes such as tournament results, rankings, or selection into national or international teams.15. Limitation of Liability
To the maximum extent permitted by law:
HBC, HAP Sports Trust, Hatsun Agro Product Limited, and their trustees, officers, employees, coaches, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunity, reputation, or revenue, arising out of or in connection with your use of the Platform or services.The total aggregate liability of HBC for any claim arising under these Terms shall not exceed the total fees paid by you to HBC in the twelve (12) months preceding the event giving rise to the claim, or INR 5,000, whichever is lower.16. Indemnification
You agree to indemnify, defend, and hold harmless HBC, HAP Sports Trust, and their respective trustees, officers, employees, coaches, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
Your breach of these Terms or the Privacy Policy.Your violation of any law or third-party right.Submission of false, inaccurate, or misleading information.Misuse of the Platform or any Content.17. Suspension and Termination
HBC may, at its sole discretion, suspend or terminate your access to the Platform or your enrolment in any programme, with or without notice, for any breach of these Terms, the Code of Conduct, or applicable law.You may discontinue use of the Platform at any time. Upon termination, certain provisions including intellectual property, disclaimers, limitation of liability, and indemnification shall survive.Deletion of your account does not automatically delete records that we are required to retain under law.18. Modifications to the Terms and Services
We reserve the right to modify these Terms, the Platform, or any service offered, at any time. Material changes will be notified through the Platform or via email. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms. The "Last Updated" date at the top reflects the latest revision.19. Force Majeure
HBC shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, civil unrest, strikes, power failures, internet or telecommunication outages, or technology failures.20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located at Virudhunagar / Madurai, Tamil Nadu, India.21. Dispute Resolution
The parties shall first attempt to resolve any dispute amicably through good-faith discussions within thirty (30) days of written notice.If the dispute is not resolved through discussions, it shall be referred to arbitration by a sole arbitrator appointed by HBC, in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Tamil Nadu, India, and the language shall be English.The arbitration award shall be final and binding on both parties.22. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. No waiver of any provision shall be deemed a continuing waiver of such provision or any other provision.23. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms or notices published on the Platform, constitute the entire agreement between you and HBC regarding the use of the Platform, and supersede all prior agreements and understandings.24. Contact Us
